TERMS & CONDITIONS

These Terms & Conditions apply to all bookings and use of No.3 Sound Studios, including rehearsal sessions, recording sessions, studio hire, engineering and production services, and the hire of instruments and equipment.
By making a booking with No.3 Sound Studios, you confirm that you have read, understood and agreed to these Terms & Conditions.
1. ABOUT NO.3 SOUND STUDIOS
1.1 No.3 Sound Studios ("we", "us", "our", "the Studio") provides rehearsal, recording, production, studio hire, equipment hire and associated services.
1.2 "The Customer", "you" and "your" means the person, band, artist, company or organisation making a booking or using the Studio or its equipment.
1.3 Where a booking is made on behalf of a band, group, company or organisation, the person making the booking confirms that they have authority to accept these Terms & Conditions on behalf of the relevant members or participants.
1.4 These Terms & Conditions apply to all bookings unless we have expressly agreed different terms with you in writing.
2. BOOKINGS
2.1 A booking is confirmed when we have received the required booking payment, deposit or other confirmation requested by us.
2.2 The Customer is responsible for ensuring that the booking date, time, duration, number of attendees and services required are correct.
2.3 All bookings are subject to Studio availability.
2.4 We reserve the right to decline a booking where we reasonably believe that the proposed use of the Studio or equipment is unsuitable, unsafe, unlawful or incompatible with our facilities.
2.5 Studio time is charged according to the booking period agreed at the time of booking.
2.6 Unless otherwise agreed, the booked time includes arrival, set-up, soundcheck, rehearsal or recording, packing away and departure.
2.7 Customers should therefore allow sufficient time within their booking for setting up and packing away.
3. ARRIVAL, SESSION TIMES & LATE ARRIVALS
3.1 Customers should arrive promptly at the agreed start time.
3.2 Customers arriving late will not normally receive additional Studio time to compensate for the late arrival.
3.3 A late arrival does not automatically extend the booking.
3.4 Where the Studio is available, additional time may be purchased by agreement with us.
3.5 Customers must leave the Studio promptly at the end of their booked session unless additional time has been agreed.
3.6 Continued occupation of the Studio beyond the agreed finishing time may incur additional charges.
4. CANCELLATION, RESCHEDULING & NO-SHOWS
4.1 — 24-hour cancellation policy
Customers are required to give at least 24 hours' notice if they wish to cancel or request a change to a booking.
4.2 Cancellation or rescheduling requests should be made as soon as reasonably possible by contacting No.3 Sound Studios using the contact details provided at the time of booking.
4.3 Where a booking is cancelled or rescheduling is requested with less than 24 hours' notice, the Studio reserves the right to charge the booking fee, or a reasonable cancellation charge reflecting the Studio's direct loss arising from the late cancellation.
4.4 Where a customer fails to attend a booking without giving notice ("no-show"), the Studio reserves the right to charge the booking fee or an appropriate cancellation charge reflecting the resulting loss.
4.5 Where a late cancellation slot can reasonably be re-booked with another customer, we will take that into account when determining any cancellation charge.
4.6 We may, at our discretion, waive or reduce a cancellation charge where there are genuine exceptional circumstances.
4.7 Repeated cancellations, late cancellations or no-shows may result in the Studio requiring future bookings to be paid in advance, requiring a deposit, or declining future bookings.
4.8 Where a Customer repeatedly fails to provide the required notice or repeatedly fails to attend booked sessions, No.3 Sound Studios reserves the right, at its reasonable discretion, to refuse or restrict future access to the Studio.
4.9 Any decision to restrict future bookings will be considered on the circumstances of the individual case.
4.10 Nothing in this section affects any statutory cancellation or consumer rights that cannot legally be excluded or restricted.
This approach is intentional: UK consumer guidance recognises that businesses can protect themselves against cancellation losses, but charges should be proportionate and businesses should take reasonable steps to minimise their losses.
5. CANCELLATION BY NO.3 SOUND STUDIOS
5.1 We may cancel or reschedule a booking where reasonably necessary due to circumstances outside our control, including serious equipment failure, building problems, utility failure, illness, emergency, severe weather, fire, flood or other circumstances affecting the safe operation of the Studio.
5.2 Where we cancel a booking and cannot provide a reasonable alternative date or equivalent service, the Customer will normally be entitled to a refund of amounts paid for the affected service.
5.3 We may cancel a booking immediately where the Customer seriously breaches these Terms & Conditions or where continued use of the Studio presents a significant safety, legal or operational risk.
5.4 Where a booking is cancelled because of serious Customer misconduct or breach, any refund will be considered in light of the circumstances and applicable law.
6. STUDIO USE
6.1 The Studio must only be used for lawful and appropriate purposes.
6.2 Customers must follow all reasonable instructions given by Studio staff.
6.3 Customers must not interfere with, alter, disconnect or move Studio equipment without permission where doing so could reasonably cause damage or affect its operation.
6.4 Studio equipment must not be removed from the premises unless specifically agreed.
6.5 Customers must not connect personal equipment to the Studio's electrical, audio or other systems where doing so could create a risk of damage or injury.
6.6 Customers are responsible for ensuring that any personal equipment brought into the Studio is safe and suitable for use.
6.7 The Studio must be left in a reasonably clean and orderly condition.
6.8 Food and drink may only be consumed in areas designated by the Studio. Food and drink must not be placed near recording equipment, mixing consoles, amplifiers, instruments, computers or other sensitive equipment.
6.9 Smoking and vaping are prohibited inside the Studio and its buildings.
6.10 Illegal drugs are strictly prohibited on the premises.
7. NUMBER OF PEOPLE
7.1 Customers must provide accurate information regarding the number of people attending where requested.
7.2 The Studio may restrict access where the number of people present creates a health, safety, fire or operational concern.
7.3 The person making the booking is responsible for ensuring that members of their party comply with these Terms & Conditions.
8. RECORDING SESSIONS
8.1 Recording sessions may include the use of microphones, preamps, mixing equipment, computers, software, outboard equipment, instruments and other Studio facilities.
8.2 Customers should discuss specific technical requirements with us before the session wherever possible.
8.3 While we will take reasonable care of recorded material, Customers should maintain their own backup of important recordings and files.
8.4 Unless otherwise agreed, the Studio does not guarantee the indefinite storage or availability of recorded material after the completion of a session.
8.5 Where recording files are supplied to the Customer, they will be supplied in the format agreed between the parties.
8.6 Additional editing, mixing, mastering, recalls, file preparation or other post-production work may incur additional charges.
9. PERSONAL PROPERTY
9.1 Customers are responsible for their own instruments, equipment, clothing, personal possessions and other property brought onto the premises.
9.2 Customers should not leave valuable personal equipment unattended.
9.3 We are not responsible for loss of or damage to personal property except where liability cannot legally be excluded or limited.
9.4 Customers are responsible for arranging appropriate insurance for valuable instruments or equipment where appropriate.
10. ADDITIONAL INSTRUMENT & EQUIPMENT HIRE
No.3 Sound Studios offers additional instruments, amplification, effects and drum equipment for use during Studio sessions.
Equipment hire is in addition to the standard Studio session fee.
Unless otherwise agreed, the following charges apply per session:

10.1 Equipment is subject to availability.
10.2 Specific makes and models cannot be guaranteed unless expressly confirmed by the Studio.
10.3 The Studio may substitute an equivalent item where the requested equipment becomes unavailable, subject to the Customer's reasonable requirements.
10.4 Additional instruments or equipment may be available upon request and may be subject to an additional charge.
11. CARE OF HIRED EQUIPMENT
11.1 All equipment remains the property of No.3 Sound Studios.
11.2 Customers must take reasonable care of all equipment supplied to them.
11.3 Equipment must only be used for its intended purpose and in a reasonable manner.
11.4 Customers must not modify, dismantle, repair, open or otherwise interfere with equipment.
11.5 Equipment must not be removed from the Studio unless specifically authorised for off-site hire.
11.6 Customers must not allow unauthorised persons to take possession of hired equipment.
11.7 Equipment must be returned at the end of the session in substantially the same condition in which it was provided, allowing for normal wear and tear.
12. EQUIPMENT DAMAGE, LOSS & THEFT
12.1 Customers are responsible for damage to, loss of or theft of hired equipment where this results from negligence, misuse, recklessness, failure to take reasonable care or breach of these Terms & Conditions.
12.2 Customers are not responsible for ordinary wear and tear or faults arising from normal and proper use.
12.3 Where equipment is damaged, the Studio will first consider whether it can reasonably be repaired.
12.4 Where repair is possible, the Customer may be charged the reasonable cost of repair.
12.5 Where equipment is lost, stolen or damaged beyond reasonable repair as a result of the Customer's responsibility, the Customer may be liable for its reasonable replacement cost.

12.6 These figures are reference values and do not constitute automatic penalties or charges.
12.7 Where the actual reasonable repair cost is lower than the applicable replacement value, the lower amount will normally be charged.
12.8 Where an equivalent replacement can reasonably be obtained at a lower cost, the lower reasonable cost will normally apply.
12.9 Where an item is completely lost, stolen or damaged beyond economical repair, the Studio may charge a reasonable replacement amount taking into account the item's age, condition, availability and equivalent replacement cost.
12.10 Nothing in this section permits the Studio to recover more than its reasonable actual loss.
13. EQUIPMENT FAULTS
13.1 Customers must notify Studio staff as soon as possible if equipment appears faulty or is not operating correctly.
13.2 Customers must not attempt to repair or modify faulty equipment.
13.3 Where equipment develops a fault through normal use, the Studio will, where reasonably possible, provide an alternative item or make appropriate arrangements.
13.4 Customers will not normally be charged for damage resulting solely from an inherent equipment fault or ordinary failure during proper use.
13.5 Customers must stop using equipment where continued use could reasonably cause further damage.
14. INSTRUMENTS
14.1 Electric guitars and other instruments are provided for reasonable use during the booked session.
14.2 Customers must treat instruments with appropriate care.
14.3 Customers must not alter the setup, electronics, strings, hardware or other components without prior permission.
14.4 Customers must notify Studio staff of any existing damage or defect they notice before using an instrument.
15. DRUMS & CYMBALS
15.1 Snares, cymbals and other drum equipment must be used appropriately and with suitable sticks, beaters and accessories.
15.2 Customers must not use inappropriate implements or excessive force where this creates an unreasonable risk of damage.
15.3 Normal marks associated with reasonable use will be regarded as normal wear and tear.
15.4 Cracks, dents, breaks or other damage resulting from misuse, inappropriate use or excessive force may be chargeable.
16. AMPLIFIERS & EFFECTS
16.1 Customers must use amplifiers and effects equipment in accordance with reasonable Studio instructions.
16.2 Customers must not connect equipment in a manner that could reasonably cause electrical or electronic damage.
16.3 Customers must not alter internal components, wiring, firmware or other non-user-accessible parts.
16.4 Any unusual noise, electrical fault, overheating or other problem must be reported immediately.
17. SECURITY DEPOSITS
17.1 A security deposit is not normally required for standard in-Studio equipment hire.
17.2 For higher-value, extended or off-site equipment hire, the Studio reserves the right to require a refundable security deposit.
17.3 Where a deposit is required, the amount will be communicated to the Customer before the hire is confirmed.
17.4 Subject to any legitimate deductions, the deposit will be returned following satisfactory return and inspection of the equipment.
17.5 Reasonable deductions may be made for damage, loss, theft, missing equipment or other costs directly resulting from the Customer's breach of these Terms & Conditions.
17.6 Any deduction will be explained to the Customer upon request.
18. OFF-SITE EQUIPMENT HIRE
18.1 Equipment must not be removed from the Studio without prior agreement.
18.2 Where off-site hire is agreed, the Customer is responsible for the equipment from the time it leaves the Studio until it is returned and accepted by No.3 Sound Studios.
18.3 Equipment must not be moved to another location without prior agreement.
18.4 The Customer must take reasonable precautions against theft, loss, weather damage, liquid damage, impact damage, overheating and electrical damage.
18.5 We may require identification, a security deposit, proof of address, evidence of insurance or other reasonable security before releasing equipment for off-site use.
18.6 We reserve the right to refuse off-site hire where we reasonably believe the equipment is at unacceptable risk.
19. COLLECTION & RETURN OF EQUIPMENT
19.1 Equipment must be collected and returned at the agreed times.
19.2 The Customer is responsible for ensuring that all equipment, cases, cables, power supplies, accessories and other components are returned.
19.3 Late returns may result in additional reasonable charges where the delay affects another booking or prevents the equipment from being hired to another customer.
19.4 Equipment must be returned in substantially the same condition in which it was supplied, allowing for normal wear and tear.
20. TRANSPORTATION OF EQUIPMENT
20.1 Customers collecting equipment are responsible for ensuring that they have suitable transportation.
20.2 Equipment must be transported securely and appropriately.
20.3 Equipment should not be left unattended in an unsecured vehicle.
20.4 Where equipment is transported by the Customer, responsibility for the equipment remains with the Customer during transportation.
21. DAMAGE TO THE STUDIO
21.1 Customers are responsible for damage caused to the Studio, fixtures, fittings, furniture or equipment by themselves or members of their party where such damage results from negligence, misuse, recklessness or breach of these Terms & Conditions.
21.2 We may charge the reasonable cost of repair or replacement.
21.3 Charges will take into account reasonable repair costs and, where appropriate, the age and condition of the damaged item.
21.4 Customers will not be charged for ordinary wear and tear.
22. NOISE & NEIGHBOURS
22.1 Customers must comply with reasonable instructions concerning volume levels and noise.
22.2 The Studio may require volume to be reduced where reasonably necessary for safety, legal, environmental or operational reasons.
22.3 Customers must not create unreasonable noise outside the Studio or behave in a manner likely to disturb neighbours or members of the public.
23. ALCOHOL, DRUGS & INTOXICATION
23.1 Alcohol consumption is permitted only where expressly authorised by No.3 Sound Studios.
23.2 Customers must behave responsibly and must not allow intoxication to create a risk to themselves, other people, the Studio or its equipment.
23.3 Illegal drugs are prohibited on the premises.
23.4 The Studio may terminate a session where a Customer's intoxication or drug use creates a safety or operational concern.
24. CHILDREN & YOUNG PEOPLE
24.1 Children and young people may attend where appropriate supervision and safeguarding arrangements are in place.
24.2 The person responsible for the booking must ensure that children and young people attending are appropriately supervised.
24.3 Children must not operate Studio equipment unless expressly authorised and appropriately supervised.
25. HEALTH & SAFETY
25.1 Customers must comply with all reasonable health and safety instructions.
25.2 Fire exits, emergency routes and safety equipment must remain unobstructed.
25.3 Cables and equipment must be positioned safely.
25.4 Customers must immediately report any accident, injury, damage or safety concern.
25.5 Customers must not use equipment in a manner that creates an unreasonable risk to themselves or others.
26. LIABILITY
26.1 We will provide our services with reasonable care and skill.
26.2 Nothing in these Terms & Conditions excludes or limits liability which cannot legally be excluded or limited.
26.3 In particular, nothing excludes or limits liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability which applicable law does not permit us to exclude or limit.
26.4 We are not responsible for indirect or consequential losses where such limitation is permitted by law.
26.5 Customers remain responsible for their own property and equipment brought onto the premises.
26.6 Nothing in these Terms & Conditions affects the Customer's statutory rights.
Consumer services must be provided with reasonable care and skill, and contractual terms cannot simply remove statutory consumer rights.
27. INTELLECTUAL PROPERTY & RECORDINGS
27.1 Unless otherwise agreed, the Customer retains ownership of their original musical performances, compositions and recordings created during a session.
27.2 The Studio does not claim ownership of a Customer's music merely because it was recorded at No.3 Sound Studios.
27.3 Any music, recordings, artwork, samples or other material supplied by the Customer must be owned or appropriately licensed by the Customer for the intended use.
27.4 The Customer is responsible for obtaining any permissions necessary for copyrighted material, samples, performances or third-party intellectual property.
27.5 No.3 Sound Studios will only use Customer recordings, photographs or other material for promotional purposes where appropriate permission has been given.
28. PHOTOGRAPHY & PROMOTIONAL MATERIAL
28.1 The Studio may photograph or film the premises for promotional purposes.
28.2 We will not knowingly use identifiable images of Customers for promotional purposes where the Customer has specifically requested that they are not photographed or filmed.
28.3 Customers may request that specific photographs or recordings featuring them are not used for promotional purposes.
29. PRIVACY & PERSONAL DATA
29.1 We collect and process personal information only as reasonably necessary to administer bookings, provide services, process payments, communicate with Customers and comply with legal obligations.
29.2 Personal information will be handled in accordance with our Privacy Policy.
29.3 Customers should refer to our Privacy Policy for further information about how personal data is collected, stored and used.
30. EVENTS OUTSIDE OUR CONTROL
30.1 We will not be liable for failure or delay in providing services where this results from circumstances beyond our reasonable control.
30.2 Such circumstances may include fire, flood, severe weather, power failure, serious equipment failure, telecommunications failure, industrial action, government restrictions, serious illness, emergency or other circumstances that could not reasonably have been prevented.
30.3 Where such circumstances affect a booking, we will make reasonable efforts to contact the Customer and, where possible, offer an alternative date or appropriate refund.
31. CUSTOMER RESPONSIBILITY FOR THEIR PARTY
31.1 The person making the booking is responsible for ensuring that all members of their party are aware of and comply with these Terms & Conditions.
31.2 The Customer may be responsible for damage caused by members of their party where that damage results from the Customer's breach of these Terms & Conditions or failure to take reasonable care.
32. TERMINATION OF A SESSION
32.1 We reserve the right to end a session immediately where:
- there is serious misconduct;
- illegal activity is taking place or reasonably suspected;
- equipment is being deliberately or recklessly damaged;
- a serious safety risk exists;
- staff or other customers are threatened, abused or harassed;
- the Customer seriously breaches these Terms & Conditions; or
- the Customer refuses to comply with reasonable Studio instructions.
32.2 Where a session is terminated because of serious Customer misconduct or breach, the Customer may remain responsible for the booking fee and reasonable additional costs arising from the breach, subject to applicable law.
33. REPEATED BREACHES & FUTURE BOOKINGS
33.1 No.3 Sound Studios aims to provide a welcoming and professional environment for all customers.
33.2 Where a Customer repeatedly cancels within the 24-hour cancellation period, repeatedly fails to attend bookings, repeatedly damages equipment, behaves inappropriately or otherwise repeatedly breaches these Terms & Conditions, we may, at our reasonable discretion:
- require future bookings to be paid in advance;
- require a security deposit;
- restrict particular services or equipment;
- decline future bookings; or
- refuse access to the Studio.
33.3 Any such decision will be made reasonably and having regard to the circumstances and seriousness of the issue.
34. COMPLAINTS
34.1 We aim to resolve concerns quickly and fairly.
34.2 Customers should contact No.3 Sound Studios as soon as reasonably possible if they are dissatisfied with a service, booking, equipment or any aspect of their experience.
34.3 Where a complaint concerns equipment damage or a technical issue, Customers should provide photographs or other relevant information where available.
34.4 We will investigate complaints reasonably and aim to provide an appropriate response.
35. CHANGES TO THESE TERMS
35.1 We may update these Terms & Conditions from time to time.
35.2 The version in force at the time a booking is made will normally apply to that booking.
35.3 Changes will not retrospectively alter the agreed terms of an existing booking unless required by law or agreed with the Customer.
36. GOVERNING LAW
36.1 These Terms & Conditions and any contract between No.3 Sound Studios and the Customer shall be governed by the laws of England and Wales.
36.2 Any dispute shall be subject to the jurisdiction of the courts of England and Wales, subject to any applicable consumer rights regarding jurisdiction.
37. STATUTORY RIGHTS
37.1 Nothing in these Terms & Conditions is intended to remove or restrict any legal rights that the Customer has under applicable UK law.
37.2 Where the Customer is a consumer, statutory rights relating to services continue to apply.
